Michael's Bio

Michael is the founder and managing attorney of The Zorkin Firm.  Michael represents managed care plans and insurers in complex disputes affecting the managed care industry, including provider disputes, contract disputes, ERISA and bad faith actions, administrative hearings, and government investigations.  He also advises clients on a wide variety of legal and regulatory issues impacting the healthcare sector.  Michael's clients can count on his unmatched expertise in managed care laws and regulations, including the Knox-Keene Act, California Insurance Code, ERISA, FEHBA, HIPAA, the Medicare Act, and the No Surprises Act.

 

In addition to his healthcare practice, Michael represents companies and high-net-worth individuals in high-stakes business litigation, with an emphasis on shareholder disputes, partnership disputes, business torts, unfair business practices actions, anti-SLAPP actions, and contract disputes.  Michael specializes in cross-border disputes and managing multi-national litigation and arbitration in the U.S. and Europe. 


Across practice groups, Michael is knowledgeable in all facets of civil litigation, including successfully litigating jury trials, arbitrations, and achieving favorable resolution of cases in mediations.


Prior to founding his practice, Michael was an attorney in the Los Angeles office of a national firm Manatt, Phelps & Phillips, LLP.  Michael now brings "big law" experience and expertise to his own practice where he continues to achieve results for clients in complex litigation matters.    


Michael graduated from UCLA School of Law. During law school, he was the chief managing editor of the UCLA Entertainment Law Review.

  • Obtained unanimous defense verdict in a jury trial for a major California health plan against an out-of-network neurosurgery practice.  Successfully established that the provider was properly paid. 


  • Negotiated dismissal with prejudice in exchange for a waiver of costs against a member alleging improper premium increases. 


  • Obtained defense verdict in a jury trial in Los Angeles County for a major California health plan against an out-of-network neurosurgery practice.  Successfully established that the provider was properly paid.


  • Summary judgment of implied contract and violations of statutes claims for a major California health plan against an out-of-network orthopedic surgeon.


  • Summary adjudication of a breach of contract claim alleging an obligation to pay based on a contract with a third-party network for a major California health plan against a major hospital system.

   

  • Summary judgment of contract and fraud claims for a major California health plan against an out-of-network pharmacy seeking $40 million in underpayments.   


  • Demurrer sustained without leave to amend against a member alleging improper payment of medical claims. 


  • Negotiated a favorable settlement against an out-of-network ambulatory surgical center in federal court after motion to dismiss was granted with leave to amend.   


  • Negotiated dismissal with prejudice in exchange for a waiver of costs against a major hospital system seeking additional payment for emergency services.   


  • Negotiated a favorable settlement against a member alleging improper payment of medical claims while abroad due to the COVID-19 pandemic.


  • Demurrer sustained without leave to amend on federal preemption grounds against an air ambulance alleging underpayment of medical claims.


  • Demurrer sustained without leave to amend against a member seeking to hold the health plan liable for medical malpractice. 


  • Demurrer sustained in a voidable transfer action against Russian banks going after U.S. citizens.
